This is an appeal by the plaintiff Jones of the dismissal of her complaint alleging racial discrimination under Title VII of the Civil Rights Act of 1964, as amended, 42 U.S.C. § 2000e et seq. The district court dismissed the plaintiffs complaint on the basis that she failed to timely file a charge of discrimination with the Equal Employment Opportunity Commission (EEOC). The court held that under Section 706(e), as amended, 42 U.S.C. § 2000e-5(e), a charge of discrimination must be filed with the EEOC within 180 days of the alleged unlawful conduct. The district court also held that the plaintiff failed to timely file a charge of discrimination with the Kentucky Commission on Human Rights (KCHR), which has a 180-day limitation period under state law. Ky. Rev. Stat. § 344.200. The district court held, therefore, that inasmuch as the plaintiff failed to timely file with an appropriate state agency, the 300-day extension of Section 706(e), 42 U.S.C. § 2000e-5(e), is not applicable.
